New Consumer Information Notice required to be displayed from 1 July 2008.

From 1 July 2008, all motor vehicle traders will need to complete and display the new Consumer Information Notice (CIN) when a used motor vehicle is offered for sale.

The Consumer Information Notice (CIN) replaces the current Supplier Information Notice (SIN).

The Consumer Information Notice (CIN) has been designed to provide information clearly to consumers and for ease of completion by traders. The information on the reverse of the CIN has been updated.

The specific changes seen as a result of the introduction of the new CIN, compared to the current Supplier Information Notice, are:

  • Vehicle Year: the definition is now the vehicle year of the motor vehicle as recorded on the Motor Vehicle Register. For motor vehicles registered before 1 January 2007, vehicle year means the year of manufacture or the model year or the year of first registration. For motor vehicles registered after 1 January 2007, vehicle year means the year of first registration anywhere in the world.
  • Registered motor vehicle trader: tick box removed. Contact details and registration number remain.
  • Cash Price: the Cash Price value must include GST, registration and licensing costs. This will ensure there is a consistent approach to the disclosure of cash price.
  • Security Interest: addition of a tick box system to show whether or not a security interest exists.
  • Radio Receiver Capability: provision of information on whether the vehicle has a radio receiver capable of receiving broadcasts in the range of 88 to 108 MHz without the use of a band expander. A tick box system is used to show the capability.
  • Vehicle Licence: addition of a tick box system to show if the vehicle is licensed. The licence expiry date is displayed in a separate field.
  • Trader Confirmation: the trader must now confirm they have supplied to the buyer a copy or electronic version of the CIN.
  • Renaming: the Supplier Information Notice (SIN) to Consumer Information Notice (CIN). The title and other wording have been changed to highlight that the information is meant for the consumer’s consideration.

Reverse of Notice

  • Wording on the reverse of the Notice has been revised to make it more readable. Information has been rearranged to bring attention to things to consider before the vehicle is purchased and post sale advice is included.
  • Contact details of Motor Vehicle Trader Register, Land Transport NZ, and the Motor Vehicle Disputes Tribunal have been updated.

The CIN requirements are set out in the new Consumer Information Standards (Used Motor Vehicles) Regulations 2008. The Regulations result from extensive consultation over the last two years on improving the operation of the Motor Vehicle Sales Act and its associated regulations.

Background: Why this change has taken place

  • The Motor Vehicles Sales Act 2003 (MVSA) came into force in December 2003.
  • Section 163 of the MVSA required the Ministry of Consumer Affairs to undertake a review of the operation of the MVSA within two years of its commencement, and to report back to the Minister with recommendations on whether any amendments to the MVSA were necessary, or desirable.
  • The Ministry of Consumer Affairs prepared a review report and the Minister of Consumer Affairs presented a copy of this report to the House of Representatives in March 2006.
  • Following from the review’s recommendations the Ministry prepared two discussion documents. The first, released in 2006, recommended amendments to the information disclosure provisions set out in the Consumer Information Standards (Used Motor Vehicles) Regulations 2003. The second, released in 2007, addressed proposed amendments to the MVSA.
  • A further discussion paper on the recommended changes to the Consumer Information Standards (Used Motor Vehicles) Regulations 2003 was published in 2007.

Proposed Motor Vehicle Sales Act changes

Separately, changes are also proposed to the Act. These will be introduced to Parliament and will address:

  • amending the annual renewal process for motor vehicle trader registration
  • making it easier to ban non registered traders from participating in the industry
  • removing the requirement for private sellers at car markets to display a Consumer Information Notice
  • improving procedures related to the Motor Vehicle Disputes Tribunal including awarding of costs for non attendance, allowing the tribunal to publish all decisions and increasing the dollar value of claims able to be heard.
